These Terms of Service constitute a legally binding agreement made between you and Aveara, concerning your access to and use of our website and services. By accessing the site, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service.

These terms are governed by the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Consumer Protection (E-Commerce) Rules, 2020.

2. User Eligibility

Use of our website is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Act, including minors, un-discharged insolvents, etc., are not eligible to use the website. If you are a minor, you may use the site only under the supervision of a parent or legal guardian.

3. Products and Pricing

All products listed on the website are subject to availability. We reserve the right to discontinue any product at any time for any reason. Prices for all products are subject to change without notice. All prices are inclusive of GST unless stated otherwise.

4. Payments and Cash on Delivery (COD)

We offer multiple payment options, including secure UPI, credit/debit cards, and Cash on Delivery (COD).

• Prepaid Orders: Processed immediately upon successful payment authorization.
• COD Orders: Available for select pin codes. We reserve the right to verify COD orders via phone or SMS prior to dispatch to prevent fraudulent activity.

5. Shipping and Express Dispatch

We pride ourselves on our "Express Dispatch" commitment. Orders are typically dispatched within 24-48 hours. Delivery timelines vary based on your location in India but generally take 3-7 business days. Aveara is not liable for delays caused by courier partners or unforeseen circumstances (force majeure).

6. Returns and Refunds

As part of our commitment to quality, we offer a 15-Day Return Policy. To be eligible for a return:

• The item must be unused, unwashed, and in the same condition that you received it.
• It must be in the original packaging with all tags attached.

Refunds for prepaid orders will be credited to the original payment method. For COD orders, refunds will be processed via bank transfer or store credit, subject to verification.

7. Intellectual Property

Unless otherwise indicated, the website and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the site (collectively, the "Content") are owned or controlled by Aveara, and are protected by copyright and trademark laws of India.

8. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the site, even if we have been advised of the possibility of such damages.

9. Governing Law and Jurisdiction

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of India. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in India.
